Virtual Exhibitions: Terms and Conditions

Every client, buyer, artist that uses Lagunaart.com and is paying for service or prodduct is agreeing to the full terms and conditions listed below.

Virtual Exhibitions

  • It may take between 2 weeks and 2 months to upload an artist’s profile for Lifetime Membership and virtual exhibitions due to communications between the online curator and the artist.

  • By submitting payment, the artist confirms they have read and agree to all terms and conditions stated here.


1. Website Terms

By accessing this website and signing up, you agree to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and you confirm you are responsible for complying with any applicable local laws. If you do not agree with these terms, you may not use this site. All materials on this site are protected by applicable copyright and trademark laws.


1A. Refund Policy

  • All sales are final, and items are sold as is, in their current condition.

  • No refunds will be issued for fine art purchases, virtual exhibitions, artist memberships, artist services, or art gallery wall rental exhibitions, if 50/50 consignment is on the agreement it is considered straight consigment, if 90/10 is on the agreement it is considered a wall rental situation, this refund policy is to the fullest extent permitted by law.

  • The artist is responsible for:

    1. Providing proper high-resolution images, biography, and artist statement before upload, in a timely manner.

    2. Shipping artwork early enough to arrive prior to the exhibition.

    3. Presenting artwork in a gallery-ready condition, including framing and hanging hardware (wired and ready to hang). Works requiring clips may not be displayed.

  • If artwork fails to meet these requirements, no refund or credit will be issued.

  • Once an artist reserves and pays for a space, that space is considered booked, marketed, and promoted.

  • LagunaART.com is not responsible for loss, theft, or damage to artwork during shipping or handling. Liability for the artwork ends once the piece leaves the gallery’s possession.

  • If an artist cannot exhibit in the scheduled month, the date may be rescheduled to the next available month by mutual agreement.


1B. Commissions on Consignment

  • Commission rates vary depending on the type of sale; see the artist’s signed agreement for details.

  • All physical gallery sales are handled under the terms outlined in the artist’s private consignment agreement.


Shipping Policy

  • Artists are responsible for delivering or shipping artwork to and from the gallery, including all costs and proper packing.

  • The gallery can provide shipping contact information if needed.

  • Collectors are responsible for all shipping costs when the artwork is delivered to their home or office.

  • LagunaART.com’s liability for artwork ends once the work leaves its possession.


2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on LagunaART.com’s website for personal, non-commercial, transitory viewing only. This is a license, not a transfer of title. Under this license, you may not:

  • Modify or copy the materials.

  • Use the materials for any commercial purpose or public display.

  • Attempt to decompile or reverse-engineer any software on the site.

  • Remove copyright or proprietary notices from materials.

  • Transfer materials to another person or “mirror” them on any other server.

This license terminates automatically if you violate any restriction and may be terminated by LagunaART.com at any time. Upon termination, you must destroy any downloaded materials in your possession.


3. Disclaimer

The materials on LagunaART.com’s site are provided “as is.” LagunaART.com makes no warranties, express or implied, and disclaims all other warranties to the fullest extent permitted by law. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

The gallery is not responsible for loss, theft, or damage to artwork while stored, shipped, or exhibited. All artwork must be insured by the owner. A storage fee of $200/month applies to artwork left more than 30 days after notice of pickup. The artist will be given written notice before the artwork is considered abandoned. Art left beyond 60 days without a rental agreement may be considered abandoned and disposed of at the gallery’s discretion.


4. Limitations

In no event shall LagunaART.com or its suppliers be liable for damages (including, without limitation, loss of data, loss of profits, or business interruption) arising from use or inability to use the website or its materials, even if advised of the possibility of such damages. Certain jurisdictions do not allow these limitations, so some may not apply.


5. Content & Artwork Removal

LagunaART.com reserves the right, at its sole discretion, to remove any content or artwork deemed offensive, inappropriate, or below quality standards.


6. Revisions

LagunaART.com may revise these terms at any time without notice. By continuing to use the website after such changes, you agree to be bound by the updated terms.


7. Governing Law

Any claim relating to LagunaART.com’s website shall be governed by the laws of the State of New York without regard to conflict of law provisions.


8. Artist Application Fee

  • A one-time, non-refundable $250 application fee covers review by the art director, rotation in the LagunaART.com iPhone app, listing in the shopping cart, and first notice of calls for artists.

  • Payment of this fee does not guarantee a solo exhibition but grants the opportunity to apply for group exhibitions.


9. Artist/Artwork Liability

  • LagunaART.com is not responsible for arranging shipment between an artist’s studio and a client.

  • Artists must insure their own works during transport and while in their possession.
